[I will make up names] my friend is American his name is Mark, he has a baby with a women who is Mexican, Carla. Their baby is Mark Jr. So Mark has been a responsible father, he lives in San Diego, CA and visits his son frequently at Tijuana, Mexico where Carla lives with her family. (Mark&Carla are not together as a couple anymore) Mark brings food, toys, clothes, you name it to Carla’s home for baby Mark Jr. THE PROBLEM is Carla is refusing to let Mark bring Mark Jr. over to San Diego. Mark Jr. already has all the legal papers, like his birth certificate and his passport to come over the US. Doesn’t my friend have the right to tell Carla “By law I’m allowed to bring the baby with me over to San Diego”???? I mean my friend Mark wants to bring Mark Jr. over to San Diego for a day because of a family celebration, it’s not like he’s taking away the baby forever. How can I help my friend find out his legal rights so that he can make Carla understand he has rights too.

He needs to consult an attorney. That is a complicated situation.
Are their legal joint custody papers? If so, She has no right to do that. Even so, If this kid is his, he has rights just like her. He should take her to court, take a paternity test, and file joint custody or full, and take his kid whenever he wants. She sounds greedy, keeping ‘mark jr.’ to herself.
This is an immigration problem my friend is going thru the same your friend is going to have to get an attorney and depending on wether or not the child was born here or Mexico it all depends.And he will have to get an immigration attorney dealing with family law because like i said depending on what country the baby was born in and now the baby has residency in Mexico papers or no papers he will have to establish visitation.
strictly legal, it depends if the child is Mexican or American of nationality, then there would have to be a legal battle for the child in this country. sounds like she is lower class( not in a bad way) and she is frightened that he will take her baby away and not bring him back. they need to work on their relationship as a family and as parents before they traumatize the poor kid.
